This Privacy Notice for California Residents (“California Privacy Notice”) supplements the information contained in our Privacy Policy above and applies solely to all visitors, users, and others who reside in the State of California (”consumers” or “you”). Orchid Bee Writing & Consulting LLC dba Stoned Evaders adopted this notice to comply with the California Consumer Privacy Rights Act of 2018 (“CCPA”), the California Privacy Rights Act of 2020 (“CPRA”), and any implementing regulations adopted thereunder. Terms (including defined capitalized terms) used in this California Privacy Notice have the same meanings given in the CCPA and CPRA and the associated regulations, unless otherwise defined. Stoned Evaders is an assumed name of Orchid Bee Writing & Consulting LLC registered in The State of Texas, United States of America.
Information We Collect
“Personal Information” (PI) or “Personal Data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.
We collect personal data, either directly from you, most of the time obtained through forms on the Stoned Evaders Website (www.stonedevaders.com), or indirectly when you interact with us.
The Stoned Evaders Website (www.stonedevaders.com) collects information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household (”Personal Information”). C. Characteristics of protected classifications under California or federal law. Ethnic Group, gender, marital status, religion, donor information, financial demographics.

D. Commercial information. Records of personal property, products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.

Personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership.” This category of information is NOT collected.
Orchid Bee Writing & Consulting LLC may also use your information to respond to law enforcement requests and as required by applicable law, court order, or governmental regulations; As described to you when collecting your Personal Information or as otherwise set forth in the CCPA.
Orchid Bee Writing & Consulting LLC will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

Your Rights and Choices
The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.
i. RIGHT TO ACCESS You have the right to access Personal Information which we may collect or retain about you. If requested, we shall provide you with a copy of your Personal Information which we collect as permitted by law. You also have the right to receive your Personal Information in a structured and commonly used format so that it can be transferred to another entity (“data portability”).

You have the right to request that we disclose the following about your Personal Information, as defined by law:

Our use of targeted advertising and tracking technologies may be considered a “sale”/ “sharing” under certain privacy laws. For example, the California law, the CCPA, under the definition of “sell” and “share”, we “sell” or “share” the following categories of personal information in order to deliver a more personalized experience and to show you products that we think you’ll be interested in: Identifiers; commercial information; Internet or other electronic network activity; geolocation data; and inferences drawn from these categories. Per the CCPA’s definition of “sell” and “share”, we “sell” or “share” personal information to the following categories of vendors: advertisers and marketing partners, data analytics providers, service providers, and social media networks. We do not knowingly “sell” or “share” the personal information of consumers under 18 years of age.
You have the right to direct us to not “sell” or “share” your personal information at any time (the "right to opt-out"). You can make a Do Not Sell/Share request by contacting us at support@orchidbeewriting.com. We will process your Opt-Out request within 15 days and will notify third parties of your request.
You may change your mind and opt back into personal information sales at any time by contacting us at support@orchidbeewriting.com.
You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.
iv. RIGHT TO REQUEST THAT WE DO NOT COLLECT, SHARE, OR DISCLOSE MY SENSITIVE PERSONAL INFORMATION
You have the right to limit how your Sensitive Personal Information (SPI) is disclosed or shared with third parties, as defined in the CCPA/CPRA. Please note that we do not sell your sensitive personal information and only share it for excepted purposes.
v. RIGHT TO DELETION
In certain circumstances, you have the right to request the erasure of your Personal Information. Upon verifying the validity of a deletion request, we will delete your Personal Information from our records, and instruct any service providers or third parties to delete your information, when applicable.
vi. RIGHT TO CORRECT/RIGHT TO RECTIFICATION
In certain circumstances, you have the right to request correction of any inaccurate Personal Information. Upon verifying the validity of a verifiable consumer correction request, we will use commercially reasonable efforts to correct your Personal Information as directed, taking into account the nature of the Personal Information and the purposes of maintaining your Personal Information.
vii. ACCESS AND OPT OUT OF AUTOMATED DECISION MAKING INCLUDING PROFILING
Please note that the above rights are not absolute, and we may be entitled to refuse requests, wholly or partly, where exceptions under applicable law apply.
EXERCISING YOUR RIGHTS
If you are a resident of California, you can exercise any of your rights as described in this Policy/Notice and under applicable privacy laws by using the contact information provided in this Policy/Notice. We will not discriminate against you for exercising such rights. Except as described in this Policy/Notice or provided for under applicable privacy laws, there is no charge to exercise of your legal rights.
Exercising Your Rights
To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by contacting us at support@orchidbeewriting.com. Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.
You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

Provide sufficient information that allows Orchid Bee Writing & Consulting LLC to reasonably verify you are the person about whom we collected personal information or an authorized representative.

Describe your request with sufficient detail that allows Orchid Bee Writing & Consulting LLC to properly understand, evaluate, and respond to it.
Response Timing and Format
Orchid Bee Writing & Consulting LLC endeavors to respond to a verifiable consumer request within forty-five (45) days of its receipt. If it requires more time (up to 90 days), it will inform you of the reason and extension period in writing.
Orchid Bee Writing & Consulting LLC will deliver its written response by mail or electronically, at your option.
Any disclosures Orchid Bee Writing & Consulting LLC provides will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response will also explain the reasons Orchid Bee Writing & Consulting LLC cannot comply with a request, if applicable. For data portability requests, Orchid Bee Writing & Consulting LLC will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically by electronic mail communication.
Non-Discrimination
Orchid Bee Writing & Consulting LLC will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, Orchid Bee Writing & Consulting LLC will not:

Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

Provide you a different level or quality of goods or services.

Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
However, Orchid Bee Writing & Consulting LLC may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
Data Retention
Unless you request its deletion, Orchid Bee Writing & Consulting LLC will retain your information for as long as your account is active, your information is needed to provide you with products or services, as required to fulfil the purposes outlined in this California Privacy Notice, or as required to fulfill Orchid Bee Writing & Consulting LLC’s legal obligations.
Childrens’ Data
The Stoned Evaders Website is designed and intended for those who are 18 years of age or older.
By using the Stoned Evaders Website, you affirm that you are at least 18 years of age or older. We are not liable for any damages that may result from a user’s misrepresentation of age. No one under age 18 is authorized to submit or post any information, including personal information, on the Stoned Evaders Website. Under no circumstances may anyone under age 18 use the Stoned Evaders Website. Parents or legal guardians of children under 18 cannot agree to these Terms on their behalf. We do not sell products or services for purchase by anyone under the age of 18.
We do not knowingly collect, use, sell, share, or solicit personal information from anyone under the age of 18. If you are under 18, please do not attempt to register for an account, attempt to purchase a product or service, or send us any of your personal information. If we learn that we have collected personal information from a child under age 18, we will take steps to delete the information. In cases where you have authorized a minor to use the Stoned Evaders Website, you recognize that you are fully responsible for: (i) the online conduct of such minor; (ii) controlling the minor's access to and use of the Stoned Evaders Website; and (iii) the consequences of any misuse by the minor. You acknowledge that Orchid Bee Writing & Consulting LLC has no obligation to monitor the content accessible on or through the Stoned Evaders Website.
Changes to Our California Privacy Notice
Orchid Bee Writing & Consulting LLC reserves the right to amend this California Privacy Notice at its discretion and at any time. When Orchid Bee Writing & Consulting LLC makes changes to the California Privacy Notice, it will post the updated notice on the Stoned Evaders Website and update the notice’s effective date. Your continued use of the Stoned Evaders Website following the posting of changes constitutes your acceptance of such changes.
